Estate Planning

Our Estate Planning & Advance Directives practice provides clients with peace of mind. Planning may include a Last Will & Testament (including optional Guardianship, UTMA and/or Testamentary Trust provisions), Health Care Proxy, Durable Power of Attorney and Living Will.

Estate Administration

Our Estate Administration practice represents executors and administrators in the probate or intestate administration of decedent’s estates before the Surrogate’s Court. We handle all aspects of estate administration, including the filing of federal estate tax returns (Form 706) and New York estate tax returns (Form ET-706) and the disposition of all estate assets (including residential or commercial real property owned by the decedent). We also provide representation regarding non-probate death claims.).

Non-Probate Planning

We regularly counsel clients regarding non-probate planning opportunities using Revocable Trusts, Irrevocable Trusts (including Supplemental Needs Trusts) and deed transfers involving Life Estates.
We also help clients to coordinate planning with the beneficiary designations associated with their financial and insurance non-probate assets. Such assets may include transfer on death (“TOD”) accounts, Rollover IRAs, Inherited IRAs, Traditional IRAs, Roth IRAs, SEP IRAs, SIMPLE IRAs, 401(k)s, 403(b)s, 457(b)s, annuities, life insurance, 529 College Savings Plans, other retirement plans and bank accounts with beneficiary designations (often titled as “POD” or “ITF” accounts).

Surrogate Court Proceedings

We represent parties in connection with proceedings and accountings (including voluntary or compulsory accountings) before the Surrogate’s Court in all counties of New York State.
